The short version
These Terms explain how the estimator, booking, payments, and customer portal work, and the rules for using the Site. The biggest things to know:
- Instant estimates are not final bids and may change after inspection.
- A deposit is required to reserve a project; cancellation rules apply.
- We provide a limited workmanship warranty, with standard exclusions.
- Liability is limited to the amount paid for the specific project.
Acceptance of Terms
By accessing or using instant.moorhousecoating.com (the "Site"), including its instant quote estimator, online scheduling, payment processing, and customer portal features, you ("User" or "Customer") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Site.
These Terms constitute a legally binding agreement between you and Moorhouse Coating, Inc. ("Moorhouse Coating," "we," "us," or "our"), located at 42480 Ritter Circle STE 1, Palm Desert, CA 92211.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site following any such changes constitutes your acceptance of the revised Terms.
Use of the Site
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of yourself or any entity you represent. By using the Site, you represent and warrant that you meet these requirements.
You agree to use the Site only for lawful purposes and in accordance with these Terms.
- Use the Site in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to any portion of the Site or its systems.
- Transmit false, inaccurate, or misleading information.
- Interfere with or disrupt the integrity or performance of the Site.
Instant Quote & Estimator Tool
3.1 Estimates are not final bids
The instant quote and estimator tool is provided for general informational and planning purposes only. All figures generated by the estimator tool are preliminary estimates based on the information you provide and general pricing parameters. They do not constitute a firm offer, final bid, or binding contract.
Actual project costs may differ based on actual site conditions, surface preparation requirements, materials pricing at the time of work, accessibility, project complexity, and any scope additions or changes requested by the Customer.
3.2 Accuracy of information you provide
The accuracy of any estimate generated by the tool depends entirely on the accuracy of the information you provide, including square footage, surface type, number of stories, project type, and other inputs. Moorhouse Coating is not responsible for estimates that are inaccurate due to incorrect or incomplete information provided by the User.
3.3 No guarantee of availability or pricing
Receipt of an instant estimate does not guarantee availability of scheduling, pricing, or materials. All estimates are subject to on-site inspection and final proposal approval before any work begins. Moorhouse Coating reserves the right to adjust, decline, or withdraw any estimate at any time prior to execution of a signed proposal.
3.4 Estimate validity
Estimates generated through the Site are valid for thirty (30) days from the date of generation, subject to change based on market conditions, material costs, and labor rates. After thirty (30) days, pricing may be revised in accordance with the inflation adjustment clause described in Section 8.
Online Booking & Scheduling
4.1 Scheduling requests
Submitting a booking or scheduling request through the Site does not guarantee a confirmed appointment. All scheduling requests are subject to Moorhouse Coating's availability confirmation and execution of a signed proposal. You will receive a confirmation via email or phone once your appointment has been verified.
4.2 Customer responsibilities for scheduling
To ensure work can proceed as scheduled, Customer agrees to:
- Provide accurate site access information at the time of booking.
- Ensure the property is accessible on the scheduled date and time.
- For commercial projects, provide utility access (water, electricity) and adequate on-site storage for equipment and materials.
- For HOA or multi-unit projects, coordinate resident notifications and obtain any required approvals prior to the scheduled start date.
4.3 Rescheduling by customer
You may reschedule a confirmed appointment at no charge by providing at least forty- eight (48) hours' notice prior to the scheduled start date. Rescheduling requests made with less than forty-eight (48) hours' notice may result in a rescheduling fee as described in Section 7.
4.4 Rescheduling by Moorhouse Coating
Moorhouse Coating reserves the right to reschedule appointments due to weather conditions, equipment issues, crew availability, or other circumstances beyond our reasonable control. We will notify you as soon as practicable and will work with you to find an acceptable alternative date.
Customer Portal & Account Management
5.1 Account creation
To access certain features of the Site, including viewing estimates, project history, and making payments, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
5.2 Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@moorhousecoating.com if you suspect any unauthorized access to or use of your account.
5.3 Account termination
We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms, failure to pay outstanding balances, or fraudulent activity. You may request deletion of your account by contacting us at info@moorhousecoating.com.
Payments & Billing
6.1 Accepted payment methods
Moorhouse Coating accepts payment via cash, check, and major credit cards. Online payments made through the Site are processed by a third-party payment processor. By submitting payment information, you authorize Moorhouse Coating and its payment processor to charge the specified amount.
6.2 Deposit requirements
A deposit of thirty percent (30%) of the total project cost is required to reserve your appointment and authorize commencement of work. The deposit is due upon execution of a signed proposal and may be paid through the Site or by other accepted payment methods.
6.3 Progress payments
- For projects expected to be completed within one (1) month: a progress payment of fifty percent (50%) of the remaining balance is due at the halfway point of the project, with the final balance due upon substantial completion.
- For projects spanning multiple months: monthly progress payments will be invoiced and due within ten (10) days of invoice date.
6.4 Final payment
Final payment of the remaining balance is due upon substantial completion of the work. "Substantial completion" means the work has been completed in accordance with the project scope, even if minor punch-list items remain.
6.5 Late payments
Payments not received within ten (10) days of the due date may be subject to a late fee of one and one-half percent (1.5%) per month on the outstanding balance, or the maximum rate permitted by applicable law, whichever is less. Moorhouse Coating reserves the right to suspend or cease work on any project with an overdue balance.
6.6 Taxes
Unless otherwise specified in a signed proposal, prices do not include applicable sales or use taxes. You are responsible for any taxes, levies, or duties imposed by governmental authorities in connection with the services rendered.
Cancellation Policy
7.1 Cancellation by customer
You may cancel a confirmed project at any time by providing written notice to Moorhouse Coating via email at info@moorhousecoating.com or through your customer portal. The following cancellation terms apply:
- Cancellation prior to the scheduled start date with more than five (5) business days' notice: Deposit is fully refundable, less any materials purchased or costs incurred specific to your project.
- Cancellation with two (2) to five (5) business days' notice: Deposit is refundable less a cancellation fee equal to ten percent (10%) of the total project estimate, plus any materials purchased or costs incurred.
- Cancellation with fewer than two (2) business days' notice or after work has commenced: No refund of deposit. Customer is responsible for payment of work completed to date plus any materials purchased.
7.2 Rescheduling fee
Rescheduling requests made with less than forty-eight (48) hours' notice prior to the scheduled start date will incur a rescheduling fee of up to $150, at Moorhouse Coating's discretion.
7.3 Cancellation by Moorhouse Coating
Moorhouse Coating reserves the right to cancel a project prior to commencement if: (a) site conditions present safety hazards that cannot be reasonably mitigated; (b) the Customer has failed to provide required access or approvals; (c) hazardous materials (including lead paint) requiring abatement are discovered; or (d) payment obligations are not met. In the event Moorhouse Coating cancels for reasons not attributable to the Customer, the full deposit will be refunded.
Pricing & Inflation Adjustment
Pricing reflected in estimates and proposals is based on prevailing costs of labor and materials at the time of the estimate. If work is delayed beyond six (6) months from the date of the estimate, pricing may be adjusted to reflect current market conditions using the Truflation Index or a similar third-party measure. Any revised pricing will be communicated to you in writing and must be agreed upon before work proceeds.
Scope of Work & Standard Exclusions
All work is governed by the signed project proposal, which defines the agreed scope of work. The following items are generally excluded from standard service scopes unless explicitly stated in a signed proposal:
- Wood rot repair or structural repairs of any kind.
- Lead paint testing, abatement, or disposal.
- Stucco repair beyond hairline or minor surface cracks.
- Drywall repair beyond minor patching.
- Wallpaper removal.
- Furniture moving (Customer responsibility unless separately quoted).
- Specialty coatings (epoxy, anti-graffiti) unless specified.
- High-rise work requiring specialized equipment.
- Hazardous material remediation of any kind.
- Any items not expressly listed in the signed proposal scope of work.
Discovery of any excluded condition during the project will be communicated to you promptly. Additional work to address such conditions will require a written change order and agreement on additional costs before proceeding.
Limited Warranty
Moorhouse Coating warrants its labor and materials for a period of two (2) years from the date of substantial project completion. If paint failure attributable to Moorhouse Coating's workmanship or materials appears within the warranty period, we will supply the labor and materials necessary to correct the condition at no cost to you.
This warranty is provided in lieu of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. This warranty excludes:
- Damage caused by accident, abuse, misuse, or neglect.
- Damage caused by temperature extremes, moisture intrusion, or settlement.
- Cracks caused by normal expansion and contraction of substrates.
- Consequential or incidental damages of any kind.
- Deck staining: normal wear, UV fading, and damage caused by heavy foot traffic.
- Work performed at a surface preparation level below Level 2 (PDCA P14-06 Standard).
To make a warranty claim, contact us at info@moorhousecoating.com within the warranty period with a description and photographs of the issue. Warranty service is subject to our verification of the defect.
Limitation of Liability
To the fullest extent permitted by applicable law, Moorhouse Coating's total liability to you for any claim arising out of or related to the Site, any estimate, booking, payment processing, or services shall not exceed the amount paid by you to Moorhouse Coating in connection with the specific project giving rise to the claim.
In no event shall Moorhouse Coating be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or cost of substitute services, even if advised of the possibility of such damages.
Moorhouse Coating does not guarantee that: (a) the Site will be available at all times or free from errors; (b) estimates generated by the estimator tool will be accurate for any specific project; or (c) any scheduling request will be confirmed or fulfilled.
Disclaimer of Warranties
THE SITE AND ALL CONTENT, TOOLS, AND FUNCTIONALITY PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MOORHOUSE COATING DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site is free from viruses or other harmful components, that information provided is complete, accurate, or current, or that use of the Site will meet your requirements.
Data Privacy & Security
13.1 Information we collect
When you use the Site, we may collect personal information including your name, email address, phone number, property address, and payment information. We also collect information you input into the estimator tool and scheduling forms.
13.2 How we use your information
We use the information you provide to:
- Generate and deliver project estimates.
- Schedule and confirm service appointments.
- Process payments and manage your account.
- Communicate with you about your project and our services.
- Comply with legal and regulatory obligations.
13.3 Third-party service providers
We may share your information with trusted third-party service providers who assist us in operating the Site, processing payments, or delivering services. These providers are contractually obligated to keep your information confidential and may not use it for any purpose other than providing services to Moorhouse Coating.
13.4 Payment security
Payment card information entered on the Site is processed by our third-party payment processor and is encrypted using industry-standard SSL/TLS technology. Moorhouse Coating does not store your full payment card number on our systems.
13.5 California privacy rights
California residents may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, delete, and opt out of the sale of personal information. To exercise these rights, contact us at info@moorhousecoating.com. Moorhouse Coating does not sell personal information to third parties.
13.6 Data retention
We retain your information for as long as necessary to provide services, fulfill our legal obligations, and resolve disputes. You may request deletion of your personal information by contacting us, subject to our legal retention requirements.
Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Moorhouse Coating or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our express written permission.
Third-Party Links & Services
The Site may contain links to third-party websites or services. Moorhouse Coating is not responsible for the content, privacy practices, or terms of any third-party sites. Access to third-party sites is at your own risk.
Contractor Licensing
Moorhouse Coating holds the following contractor licenses:
- California: Contractors State License Board (CSLB) License No. 975178
- Arizona: Registrar of Contractors License No. ROC 326539
- Utah: Division of Occupational and Professional Licensing (DOPL) License No. 372883-5501
All services are performed by licensed, insured professionals in accordance with applicable building codes and OSHA safety standards.
Indemnification
You agree to indemnify, defend, and hold harmless Moorhouse Coating, its officers, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) inaccurate information you provide through the Site; or (d) your violation of any applicable law or the rights of any third party.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved by binding arbitration administered by JAMS in Riverside County, California, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
Notwithstanding the foregoing, disputes arising from a specific construction project may be subject to the dispute resolution provisions of the applicable signed project proposal.
Entire Agreement & Severability
These Terms, together with any signed project proposal, constitute the entire agreement between you and Moorhouse Coating with respect to your use of the Site. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Future Development
We may introduce new features, tools, integrations, or service offerings to improve the Site and customer experience. Any future enhancements may require additional data collection or new uses of existing data (for example, improved scheduling tools, customer portals, or project communications).
If future development requires material changes to how we collect, use, or share information, we will update these Terms and Conditions and provide notice as required by law. Participation in beta features will always be optional, and any additional data collected for those features will be described at the time of launch.
